Who Owns the Arkansas River Bed Contested in Kansas
A. P. report from Topeka August 15 details T. A. Naftzger of Wichita urging the Kansas executive council that the river bed belongs to either the state or the Osage Indians. The Rainbow Bend area is tied up in federal court over bed rights as landowners claim ownership only to the river’s middle, while the state claims the entire navigable bed. The state seeks oil‑lease profits by negotiating with oil firms to impound portions of income and avoid drilling in the bed. Naftzger, representing Waite Phillips Petroleum, said the firm would waive bed claims and would share one eighth of its lease income if others join, noting most oil firms would likely concede. He argued the real dispute is Osage versus state, pointing to original grants transferring territory to Osages that included the river, while later settlers’ titles may have only covered land to the bank, leaving the bed with the Indians.
