Federal appeals court blocks EPA ethanol requirement in reformulated gasoline
A three judge panel overturned the EPA rule mandating corn based ethanol as an oxygenate in cleaner burning reformulated gasoline. The decision limits how the agency can enforce fuel formulas, signaling a loss of potential revenue for corn farmers and ethanol processors estimated in the hundreds of millions. The EPA had required ethanol to make up at least 30 percent of the oxygenate mix, with MTBE as an alternative, a rule aimed at urban smog reduction.
