Wisconsin seeks injunction to block NSP power plant denied

Justice Tom C. Clark refused to block Northern States Power Co. from building a coal fueled plant on the St. Croix River at Oak Park Heights Minnesota. Wisconsin sought a preliminary injunction claiming irreparable injury pending a Supreme Court appeal. The water cooled plant would use river water with return after cooling. Wisconsin argued federal approval was required. Wisconsin officials said the ruling would enable construction without federal or state policy enforcement. Wisconsin attorney general officials prepared to seek original Supreme Court jurisdiction.
