Legal Test of 1947 Dam Law Opens in Wisconsin Courts

The Wisconsin division of the Izaak Walton League filed a circuit court challenge to a state public service commission permit authorizing the Namekagon hydro dam and power plant on the Namekagon river. The league alleges the commission failed to find whether the dam affects recreation and navigability and to weigh economic against recreational needs, asserting the 1787 Northwest Ordinance and state constitution require such consideration. The Namekagon Hydro Co. is owned by Northwest Wisconsin Electric and Dahlberg Light and Power.
