The banker’s personal appearance in the witness box is to enliven the trial amid a mess of figures, account books and ledgers. Federal Attorney Medalle continued to amass circumstantial evidence he hopes will prove that Mitchell’s sale of 18 800 shares of National City Bank stock to his wife was fake, intended merely to record a huge loss and escape taxation. He produced evidence that the banker, former head of the National Bank, made gifts totalling 250 000 to his wife during the time she held the stock. We contended these gifts were deposited in Mrs. Mitchell’s investment account and that since she had not paid her husband for the stock, about 50 000 quarterly was taken from the account and turned over to Mitchell as interest on her indebtedness, which approximated 4 000 000. Mitchell, in turn, Medalie contended, made quarterly payments to J P Morgan and Company as interest on a 6 000 000 loan for which he had pledged the stock as security. These transactions show there was no real sale to Mrs. Mitchell. The defense, headed by Max D Steuer, maintains the sale was made in good faith.
