Puryear testified he shot after his wife’s screams in May 1932 while a man with a bloody axe was present. He claimed he acted to cover up his wife and daughter’s deaths and an alleged affair with Sunshine Welker was denied. The court accepted no review of the facts. A rehearing was to be sought.
