New York April 29 AP James Matthewn Maxon Jr son of Tennessee bishop was held without bail for the grand jury on a first degree murder charge connected to the death of 73 year old David Paynter found beaten in an L side rooming house April 18 His attorney urged manslaughter but Magistrate Corrigan said the evidence showed a desire to kill and Maxon was moved to the Tombs as fellow lodgers recounted the events including entry to Maxon’s room a gas fire and the assault with a chair and threats toward residents before police arrival.
