Appeals Court rules in favor of teacher
The 8th U.S. Circuit Court of Appeals ruled that Davis, formerly a speech instructor at Arkansas A and M College, is entitled to a trial for reinstatement and damages. He alleges his dismissal without a hearing violated his First Amendment rights and seeks back pay and $25,000. The college argues immunity under the Eleventh Amendment, but the court noted sovereign immunity does not shield officials acting beyond their authority in constitutional violations.
