Rathbun Freed From Anamosa Prison By Iowa Judge

Judge Dawley in Marion on Saturday January 29 ordered Ernest Rathbun of Ida county released from the Anamosa prison where he faced a life term for criminal assault. The case ties to a district court challenge to Gov Harding's pardon as allegedly procured by fraud. The ruling states courts lack power to override pardons and that scrutiny of such matters rests with the executive. Rathbun’s order followed immediately after his arrest and transfer to Fort Madison to serve a four year term.
