Canadian Justice Seen As Speedy and Substantive
Mr Justice Riddle of the Court of King's Bench of Ontario told the New York State Bar Association that Canadian procedure aims at substantive equity rather than technicality. He contrasted Canadian practice with American limits, noting Canadians seek concrete justice even if records shock, and cited a Canadian expert alienist allowed to answer direct questions about a witness. He warned that even if an expert says a prisoner is insane, that does not excuse guilt, citing a case where the verdict hinge on the idea that knowledge of illegality mandates hanging.
