Road Laws of Montana Preserve Open Public Roads
The Montana road laws prohibit homesteaders from fencing to close roads. Only a petition to county commissioners to change a route is legal, with viewers appointed to inspect proposed paths. A road becomes legal by long public use and remains open until the board changes it. Homesteaders should petition the authorities instead of fencing crossings.
