Gilliam Ruling Opens Way for Budget Control
Attorney General Arthur Gilliam submitted a late opinion to the budget advisory committee holding that all state revenues except the common school, fire marshal and teachers retirement funds may go into the general fund. This enables complete department expenditure control and allows specific appropriations for all state entities, including educational institutions, the highway and conservation commissions. Gasoline taxes, license fees and other revenues diverted to special funds can be moved to the general fund and distributed accordingly, while funds tied to the common school must stay intact and donations or contributions cannot be placed into the general fund.
