Harrisburg Jan 6 A challenge to the validity of Pennsylvania s race wire licensing law claimed it interferes with interstate commerce The WCAU Broadcasting Co sought an injunction to stop the Public Utility Commission from enforcing the act Dr Leon Levy WCAU president warned the station could be forced out of business if it cannot broadcast horse racing events He said listeners would switch to out of state stations and advertisers would abandon WCAU Former Attorney General William A Schnader argued radio waves cross state lines and only Congress can regulate them Opposing counsel described the law as aimed at gambling by regulating private wire users and prohibiting gambling related transmissions They noted a legislative commission reported vast gambling losses Daily horse bets surpassed 2 000 000 Additional testimony showed private wire users must sign contracts not to convey gambling information Bell Telephone official W D Gillan testified he would need about 13 000 new contracts to comply
