Death sentence of killer Gilbert upheld by judge

Los Angeles Superior Court Judge George M Ell refused to reduce the death penalty for Jesse James Gilbert, 44, who was twice sentenced for murder and bank robbery. The judge denied a new trial motion as well. Gilbert, first condemned in 1964 for the murder of Sgt. George Davis during a bank raid, had his sentence upheld after a landmark Supreme Court ruling requiring counsel at lineups. The February trial again found Gilbert guilty of first degree murder and robbery, with a recommendation of death.
