Court affirms presidents pardons power in death sentences

The Supreme Court ruled 6 to 0 that the president may impose conditions in granting clemency and commute death sentences. Chief Justice Burger said pardoning power derives from the Constitution and must apply to each case individually, with the decision spotlighting related cases on fair trial claims and political advertising statutes. The Army sergeant Maurine Schick remains eligible to reapply for a full presidential pardon, though the ruling is not retroactive. Dissenters were Justices Douglas Brennen and Marshall.
