Judge rules courts can order school mergers in certain cases
In Lexington a federal judge held that district courts may order school district mergers when unconstitutional laws or violations of constitutional rights are involved. The Shelby County case, filed by the Kentucky Civil Liberties Union for five parents, argues separate districts deny education quality. The ruling contrasts earlier decisions in Louisville and Richmond on segregation, noting mergers may be ordered to achieve racial balance if invidious discrimination is proven.
