Death Penalty Overturned by Court
Washington AP reports the Supreme Court ruled 5 to 4 that a death sentence cannot be imposed by a jury from which jurors with conscientious or religious scruples against capital punishment were automatically excluded. Justice Stewart stated no defendant can be put to death by such a tribunal, noting the court found the state stacked the deck against William C. Witherspoon. Dissenting Justice Black warned the decision could broaden limitations on capital punishment.
