Severance Tax Case Is Reversed
The Arkansas Supreme Court ruled that severance taxes may be collected on timber cut from lands in a National Forest only when the lands were acquired with state consent. Timber from Ouachita National Forest taxed under a sale by the U S department may or may not be taxed depending on land status. The court remanded for factual determination of which lands were acquired versus originally owned by the United States. The decision also affirmed that a separate suit over a grocery account was voided by the statute of limitations.
