Court Affirms Highway Dept in Bridge Damage Case
LITTLE ROCK The supreme court held Lee Mode liable for actual damages to Fishtrap Bridge on Cadion creek in Faulkner county after it collapsed January 27. It reversed the Faulkner circuit court which had ruled for Mode in a $11,000 suit, saying deliberate indifference to highway signs constituted negligence per se and that damages should reflect the bridge’s value rather than replacement costs. Evidence showed truck driver Sylvester Zermation, a defendant in the lower court, admitted seeing the warning sign before crossing with heavy machinery.
