County Act Cane Ready for Trial on Appeal
Honolulu dated Nov 4 Territorial Supreme Court opened with Justices Frear Galbraith and Perry. Dole et al v Cooper et al questions constitutionality of County Act portion relating to Territorial Board of Public Institutions and handover of property from Public Works. Board appeals after Cooper refused to cede possession. If unconstitutional, effect limited to that chapter, not the whole act. The act assigns harbor and related property control to the Board and requires delivery by Public Works Superintendent.
