Court Rules Bequests For Charities Void If Undefined
Judge Parsons rules two wills contain invalid charity bequests. In Dr. Charles H. Wetmore’s will a $1500 bequest for benevolent enterprises is void for lack of definite beneficiaries, and the $1500 is to be divided among residuary daughters. In M de Medeiros Maia’s will, uncertain or impossible bequests are void. some legacies are void for vague description, others upheld as trustee gifts for charity, with the rest treated as residuary charity. The court should also appoint guardians for nieces and preserve funds to pay valid legacies after taxes.
