Challenge Law To Accept Job Challenge
Hillside attorney Emanuel Gersten filed a suit in Superior Court in Trenton for a declaratory judgment to invalidate a 1967 amendment to New Jersey Statute 40 465. The measure allows a township committee member to resign during a term to accept an appointive post by the same committee. The suit, on behalf of James P. Whitlock of 214 Exeter Way, argues the law creates preferences and inequities and is unconstitutional as a special local law.
