EPA Challenge Tests 1969 Act Reach on Tennessee Tombigbee Work
A federal judge may rule this week on a suit by the Environmental Defense Fund against the Corps of Engineers over the Tennessee Tombigbee waterway. The fund seeks a preliminary injunction halting work until an environmental impact study is updated, arguing the study must precede decisions, weigh benefits against damage, and guide this nine year, nine foot deep canal project with five dams and ten locks. The case questions timing, completeness, and significance of the impact statement with broad implications.
