Supreme Court ends presence as proof in illegal still case
The Supreme Court unanimously struck down a federal law that making a person’s mere presence at an illegal still enough for conviction was too tenuous to prove guilt. Justice Byron R. White said Congress may have power to punish presence but there is no clear indication it intended to. Romano and Ottiano, arrested Oct. 13, 1960 at a Jewett City Connecticut still, had their conviction for possessing an unregistered still reversed while other charges were left unresolved.
