Right to determine burial place under North Carolina law
The surviving spouse has the paramount right to decide burial location for a deceased person. If no spouse exists, the right passes to adult next of kin in order of relation, beginning with adult children, then the parents, followed by more distant relatives. A decedent may dictate disposition by will or testamentary gift, and the Uniform Anatomical Act allows donations via will or gift documents effective at death.
