State Agency Questions Parking Lot Eminent Domain Use

Brooks Peters of the state highway and public works commission says it would be illegal for the agency to use eminent domain to acquire land for off-street parking or for a municipality to use state gasoline funds to build or maintain such a lot. The issue arose during a meeting about purchasing land near the Raleigh highway building for a new office. The plan aligns with a long standing program to expand highway offices east of Capitol Square and follows a 1947 amendment that authorized condemnation in some cases but not for parking.
