ABA Study Urges Five Year Cap On Prison Terms
The American Bar Association study panel chaired by Simon E. Sobeloff proposes a maximum five year sentence for most felonies and urges judges to favor probation or flexible sentencing over mandatory terms. It argues current long sentences are excessive and highlights benefits of reintegration for first offenders. The plan would shift discretion to judges and reduce state and national incarceration levels. The report cites European practice and lists committee members including James V. Bennett and Herbert Wechsler.
