North Carolina ABC weighs Sherman Act clash over price postings

Raleigh officials discuss a board rule requiring malt beverage wholesalers to post proposed price changes to the ABC board every six months. The rule could curb price competition by signaling rivals when prices rise. Some wholesalers have filed identical price increases, prompting questions about legality under the Sherman Act. Assistant Attorney General James Wallace notes that if the product were not alcohol the practice might be price fixing. The rule demands filings 30 days before increases take effect, with changes slated for January 1 and July 1.

NC lawmaker calls for curbs on governor in death sentence commutations

Gastonia representative Carl Stewart urged stripping the governor’s power to commute death sentences as part of an 11 point court reform package to be pushed when the General Assembly convenes. He proposed reducing juries to six and requiring a two thirds majority to convict in non capital cases. He criticized the justice system, calling it flawed yet essential. Nine proposals would be statewide and some need constitutional amendments.
