Ex-Patrol Commander To Be Tried
A Wake County judge refused to dismiss five year old embezzlement charges against former state highway patrol commander Col. James R. Smith and two Garner men Carl W. Franks and Leonard N. Walters. Judge James H. Pou Bailey ordered trial by Aug. 1, noting lack of speedy trial guidelines and potential appellate review. The case stems from SBI findings on a 1969 scheme at the federal surplus property facility near Raleigh involving at least $10,000 in cash and property.
