In Raleigh Judge W C Harris of Wake County Superior Court ordered the State Elections Board to place the States Rights Democrats on the ballot. The ruling found the board's petition denial August 3 unreasonable and set the stage for moving to the state supreme court.
Raleigh officials say the States Rights Democratic party ballot placement fight heads to the state supreme court. Chairman Hubert Olive notes Judge Harris ordered the elections board to list the party on the general election ballot. The appeal seeks a September ruling and aims to set a future precedent.
After arguments closed, the judge ruled States Rights Democrats failed to file petitions with 10,000 qualified voters and violated a board rule barring signers who voted in primaries. The judge granted a writ of mandamus. E. H. Malone of Louisburg noted.

Washington Aug 21 The House un American Activities Committee moved to issue a subpoena for J Peters described as a former head of the communist underground. Peters faces deportation proceedings and possible immunity talks as committee aims to verify Chambers testimony linking former federal officials to the underground. The panel plans hearings with Chambers and Alger Hiss after next Wednesday.
In Colorado on U S highway 85 a head on collision killed S S Carpenter age about 60 from Rock Hill South Carolina Sonia Caldwell nine also from Rock Hill and Alma Bretey thirty of Fort Morgan Colorado. Three others in the car were injured including Leslie May Mitchum twenty five with a fractured shoulder. Merman Mitchum nineteen and Wesley Bretey thirty five sustained lighter injuries.
Senator Lodge proposes dividing electoral votes by state rather than winner takes all. Senators Sparkman of Alabama and Johnston of South Carolina say they will back the plan, arguing it would reduce minority rule and boost campaign activity in the South while reflecting regional influence in the electoral college.
Soviet papers did not carry news that the U S state department requested the recall of Soviet consul general Jacob M Lomakin in New York Lomakin booked passage on the Stockholm with his wife and two children and refused comment The hospital declined Lomakin's request to have two doctors examine Mrs Kasenkina as not surgeons and not acceptable for entry into the case
Eastern North Carolina flue cured leaf prices advanced one to three dollars per hundredweight as markets held steady on other offerings. Border belt sales showed fairly steady averages amid more common lower quality leaf. Opening day Eastern belt sales reached 9,646,840 pounds at an average of 51.93 per hundred, exceeding last year’s opening by over three million pounds and 6.61 above last season’s average, though overall opening was 2.28 below last season.
U S marshals awaited Mildred Elizabeth Gillars to land for her first return to the United States in 19 years with a treason warrant. Gillars known as Axis Sally faces a federal grand jury over wartime broadcasts from Berlin to U S troops and allied forces. The justice department noted treason requires exact evidence and two witnesses to the same overt act.
