Mistrial Sought in Pentagon Papers Case Over New Facts
Ellsberg and Russo ask for mistrial after prosecutors disclose 1971 Rand interviews. Defense says witnesses may have perjured themselves and omitted details. Judge Byrne denies mistrial but allows new questioning as rebuttal proceeds. The pair face charges of espionage conspiracy and theft for copying the Pentagon papers. Ellsberg admits leaking them in 1971. The interviews pertain to when Rand security learned of the study and its entry into the top secret control system.
