Full Court Judgment on Liquidation Appeals in Equity
The Full Court allowed an appeal from a master in equity in the compulsory winding up of John Pringle and Co. Ltd. The case concerns access to deposition transcripts held by the official liquidator and whether copies may be handed to Harold White, Leslie Dutton, Arcana Stores, and Giugra Ltd. The Chief Justice and the court weighed if copies should be produced, noting the documents were not the company’s property and considering the adequacy of the master’s August 11 1934 directions. The court found no right to automatic access, but considered rare discretion to permit copies to aid actions against a director, given the court’s approval of the sale of causes of action.
