Court Judge H Vearle Payne ordered 3 suit fled against operation of the Four Corners Power plant to be dis dismissed Monday at the request of the' plaintiffs The public nuisance suit had been filed by Ally Gen. David Norvell and several environmen tal groups including the Sierra Club New Mexico Citizens for Clean Air and Water and Har vey Mudd 11 Norvell said he and the other plaintiffs wanted the suit dis dismissed from federal court so he would file a similar suit in San Juan County District Court He said the new suit would include additional defendants and new allegations The federal suit was filed duly 7 It alleged that emissions from the coal fired generating station operat ing near Fruitland were injur riousate life and health of the hitizens of New Mexico The gun also proposed stronger pollution controls than those presently used by the state.
