Denver November 28 A $25 000 damage award sought by Olive J Fitzelmon against the Olinger Mortuary Association was reversed by the state supreme court. The action claimed mental suffering from improper acts during funeral arrangements including plane transport and publicity. The court found advertising and photographs violated the contract and caused mental distress. Judges Burke Campbell and Millard concurred.
Jean Warren a founder of Southeastern Weld and Water users in South Platte region becomes the first to receive a distribution deed for water rights under the Green City Irrigation district at dissolution. He also led the petition for organization about eight years ago in 1906 with twenty other Green City holders to share prorated rights via Riverside Bijou canal.
Separate maintenance case begins Monday in Johnston County with Mary Rix suing Charles Rix at a southwest Johnston home. The jury, drawn from local residents, will hear the contested divorce and mental cruelty claim as P. D. Nelson represents the plaintiff and HY Houtehins defends. The support issue is not before the jury. previously Mrs. Rix received $30 monthly.
Ara Tia Van Gorder 60 wife of J T R Van Gorder of northwest of Gree ney died Monday afternoon at the home of atepeod LG Van Gorder 491 Sixth street after over a year of illness. Mrs Van Gorder has two brothers living in Connecticut. Arrangements announced later. Mrs Mabel Duke 82 formerly Mabel Winegar of Gracley died Saturday at her Glendale California home after a year of ill health. Funeral service held Monday in Glendale. Duke is survived by her father George Winegar of west of Gresley and two brothers Fred and Georges Jr besides her husband Roger Duke and three year old son Donald. Winegar Sr wished with his daughter last summer, none of the Gresley relatives attended the funeral.
