Casper Hot Liable for Deaths in Gravel Pit
The Wyoming Supreme Court ruled the city of Casper was not liable for the drownings of two two year old boys at a city owned gravel pit in 1947. It upheld a Carlon county district court decision denying $25,000 in damages to the estates of Wilbur Arthur Maher and Roger Earl Griffith. The court cited prior authorities denying municipal responsibility in similar incidents and noted the site was an outlying land parcel not clearly a playground. Attorneys claimed the city failed to provide ordinary care to prevent drownings at the pit used for swimming since 1931.
