Plan Appeal of Ruling on State Income Law
Charleston June 18 An appeal to the United States Supreme Court is planned as a final test of the validity of the state income tax law. The state supreme court last week upheld the law imposing a one per cent tax on incomes over $600 annually. Attorneys for John Laing of Charleston, who sought to restrain Tax Commissioner Fred L Fox from collecting the tax, say the case will be taken to the highest court. They add a petition asking the state court to rehear the case probably will be filed before proceeding with appeal to the United States Supreme Court.
