The Archibald Herron Case and the Death Penalty Rift
Archibald Herron, a 73 year old blacksmith, faced execution for murder yet lived on in New Jersey State Prison as legal questions stalled and a century old English common law precedent guided prosecutors. The tale traces reprieves, habeas corpus, and a debate over insanity and transfer to a state hospital, a legal maze with no modern American precedent.
