Attractive nuisance doctrine raises peril for hosts

When children visit or trespass on your property you may be legally liable for injuries from hazardous items under the attractive nuisance doctrine now in force in most states. The doctrine holds you responsible for hazards a child would normally find attractive and fail to avoid, even when you are not home.

Child safety and nuisance law in young-guest injuries

A court held parents liable for a wobbling tree house hazard inviting children, while another case found a neighbor not liable after a boy injured by a couch in a garage. Age matters, and homeowners aren’t required to make premises child proof or erase minor dangers. Written by Will Bernard for a public service feature of associations.
