Kern began public life as Indiana supreme court reporter in 1882 and later served in the state senate. He was Indianapolis city attorney 1897 to 1901 and faced defeats in gubernatorial races of 1900 and 1904. The 1911 legislature named him U S senator after endorsements by the 1910 state convention. He first spoke in Goshen in 1884 seeking Cleveland Hendricks election.
