Farmers Challenge Water Law Over Ogallala Depletion
In Haskell County Kansas a fifth generation farming family led by Jay Garetson tests the state water law by filing impairment claims against their own senior rights. They warn the Ogallala Aquifer is vastly overdrawn and at risk if changes aren’t made soon. The dispute highlights the first in time, first in right rule and could redefine groundwater use in western Kansas. The case traces to 2005 with the Garetsons filing impairment on their oldest water right.
