Virginia court orders new trial for death row inmate Atkins
The Virginia Supreme Court ordered a new trial to determine whether death row inmate Daryl Atkins is mentally retarded and ineligible for capital punishment. Atkins, 18 at the time of the 1996 murder, scored 59 to 76 on IQ tests and had been sentenced to death previously, a juror prejudice claim prompting the ruling. The case stems from the shooting of Air Force enlisted man Eric Nesbitt after a robbery and ATM withdrawal.
