Lawsuit dismissal sought in county rezone dispute
Finney County District Court faces a bid to drop a lawsuit over the Sunrise Addition rezoning near Garden City. County attorney Paul Handy contends attorney Michael Friesen failed to post a bond and notify the clerk as required, while Friesen represents about 140 adjacent landowners challenging a May 21 rezoning from agricultural to multi family and commercial. The case follows a six month dispute involving planning commission votes and a series of court motions and hearings through mid May.
