Judge Denies Suppression Of Blood Test In Involuntary Manslaughter Case
Judge Stephen Nyswonger ruled the blood alcohol test taken after the Dec 14 1981 fatality was given voluntarily and that Trarbach was not under arrest at the time. The defense sought to exclude the BAT claiming lack of consent, while the prosecution contends custody occurred. A jury trial is set for January 27 with Trarbach free on bond.
