Supreme Court Rules Against Ban on Virtual Child Porn
The Supreme Court struck down the prohibition on virtual child pornography, ruling the First Amendment protects sexual images that appear to depict minors. The 6-3 decision, led by Justice Kennedy, found the Child Pornography Prevention Act too broad and vague and potentially criminalizing depictions that do not involve real children. Justice O Connor partially dissented, joined by Rehnquist and Scalia. The ruling preserves room for computer generated images while stressing precise limits on enforcement.
