A detailed Fort Smith Era account describes a deadly clash at a Cherokee Nation court house. Deputy Marshals, led by Owens and Peavey, pursued Ezekiel Proctor linked to the murder of his Cherokee wife and the earlier slaying of Deputy Marshal Bentz. Becket, a Cherokee ally, is wounded as gunfire erupts from inside and outside the court. Seven of eleven marshals die. 16–17 are wounded, including Owens. The posse, reinforced by local aides, later gathers the wounded and bodies as they plan further arrests with federal support.
