In 1585 the Park Agsembl association mortgaged property in Rome City to secure a debt of 87,500. Leases for 99 years and cottages on leased lots were built by Fort Wayne residents. After default the suit argued mortgage superiority. Judge Adair ruled the lots and improvements valid and not subject to the mortgage, declared the association insolvent, foreclosed the mortgage subject to leases, and appointed a receiver with summer assembly authority.
