Demurrer Overruled in East Berry Street Interurban Case
Judge Smith of the Portland circuit court overruled the demurrer in Evans et al versus the 8 B Fleming company. The ruling hinges on claims that East Berry street near Monroe is only thirteen feet wide, risking practical exclusion of traffic if the Fort Wayne Van Wert and Lima Traction line runs there. Interurban lines are deemed not more burdensome than city streets, with freight and express not constituting grounds for damages. The case moves toward issue joining and a trial setting.
