First Local Option Suit Reaches Indiana Supreme Court
Indianapolis April 21 The first suit testing the Indiana local option law reaches the supreme court. Charles F Galey a Crawfordsville saloonkeeper seeks to enjoin Montgomery county from calling a local option election after petitions with signatures were presented. He argues the law conflicts with the state constitution and that the election was an improper expense to taxpayers. The county later appropriated funds and Galey amended his complaint to focus on constitutionality. The case challenges sections alleging county by county determination on liquor sales and questions the uniform operation of laws across the state. The Montgomery county petition is the first test and its ruling may settle the act’s validity.
