Supreme Court Upholds Carmack Amendment Over State Rail Rules

Washington Jan 8 The Supreme Court ruled that the Carmack amendment overrides state laws on carrier liability for interstate shipments and nullifies state efforts to penalize railroads for failing to furnish cars. It voided Minnesota reciprocal demurrage, Kentucky and Nebraska laws, and stated federal law governs interstate transport charges regardless of state contracts. Justice Lurton noted rates may reflect value and that states cannot dictate car provision under Hepburn rules.

The House committee has evidence that the foreign conference line of steamers operating between the United States and South America is under European control and that they set freight rates at will.
