Case of Day versus Day in King s Bench
In Huntingdon before Mr Justice Hearn and special jurors, the case centered on the legitimacy of the defendant Thomas Day, son of a putative father, amid competing evidence and two prior verdicts in his favor. The court reviewed the claimant’s rule to grant a new trial, heard arguments from Erskine and others, and discharged the rule, upholding the defendant’s birthright and the verdicts despite insinuations of conspiracy.
